Quote Expiration

All quotes are valid for a period of 14 days from the date of issuance. After this period, pricing and availability are subject to change.


Payment Terms

Changes to the originally agreed-upon scope of work will incur additional charges, which are to be paid by the client. All changes must be documented and signed off on prior to completing any changes. If the changes or pause to discuss changes causes delays to occur there may be extra costs billed the customer.


Typically, 60% of the payment is due when the agreement has been accepted on multi-day jobs. The remaining balance is due when 50% of the project has been completed or when AMC Homes requires the remaining balance. Once the down payment is made AMC Homes will add you to the schedule. Single day or less jobs will have payments due upfront in full. Payment due upon acceptance of this agreement. Alterations to this payment schedule must be approved and specified on the contract. If the entire payment is not made upfront,  Failure to pay the balance on the completion day will result in a daily interest charge of 18% on the overdue amount. AMC Homes will determine when 50% of the project is complete as there are other factors such as material cost that determine when the final payment is due.

Time & Materials

Description: Labor will be billed at $155 per hour per technician. The total number of hours and technicians will be recorded and calculated at the completion of the job. This line reflects the time required to complete the requested service. Any pricing added to this invoice prior to the jobs completion are estimates and may need to be changed when the job is completed. Traveling to pick up materials will be charged for as well as it is time towards this project. Material costs will be calculated based on actual materials used to complete the job. Pricing will be entered upon completion and reflects the direct cost of all parts, supplies, and consumables. For time and material jobs we will estimate the project and collect 60% of the estimated project for a down payment. The project maybe finalized at the 50% completion mark to collect the estimated final payment, however, at the end of the job it will be checked again.


A 4% surcharge will be applied to all credit card payments to cover processing fees.


If repairs are expected to be covered under an insurance claim but the insurance company declines the claim, the homeowner is 100% responsible for payment.


Cancellation

A customer has 3 days to cancel the agreement once it has been signed. If an authorized agreement is cancelled by the customer there will be cancellation fees. If items can be returned they will have a restocking fee. If the cancellation is authorized there can be a cancellation fee and typically no refunds are permitted. Cancellation requests may not be accepted and it is up to the organization to decide.


Independent Contractor Status

It is mutually agreed that the Contractor shall render Services as an independent contractor. Contractor maintains his

other independent business, including appropriate business insurance and Workers Compensation Policy. Contractor

shall use his or her own tools and equipment to render Services under this Agreement.


Business License and Registration

Contractor shall comply with all state and local licensing and registration requirements for the type of Services to be

rendered under this Agreement. If applicable, the Contractor’s license and/or registration number is listed in the header

of this Agreement.


Confidentiality

Under this Agreement, Customer may provide certain confidential Information or Non-Public Personal Information

(“Confidential Information”) to the Contractor. Contractor will not disclose any Confidential Information to any third

party except to those employees or agents of Contractor who are required to have such information for purposes under

this Agreement. Contractor shall take reasonable measures to protect the secrecy of and avoid disclosure and unauthorized use of the Confidential Information. Without limiting the foregoing, Contractor shall take at least those measures that it employs to protect its own confidential information of a similar nature and shall ensure that its employees and/or agents who have access to Confidential Information employ reasonable measures to protect the secrecy and avoid disclosure and

any unauthorized use.


Miscellaneous

Authority: Each party represents and warrants that, as of the Effective Date, it has all rights, power, and authority to

enter into this Agreement and to perform its obligations. Assignment: Neither party may, by operation of law or otherwise, directly or indirectly assign this Agreement without the prior express written consent of the other party. Notices: If either party want to provide notices pursuant to this Agreement, the notices will be provided in writing and sent via email to the email addresses listed in the header of this Agreement. Counterparts: This Agreement may be executed in counterparts, each of which will constitute an original, and all of which will constitute one agreement. The parties agree that they will sign this Agreement electronically.

Attachments. Any photos or images referenced in this Agreement are attached to the Agreement under “Attachments”. Customer Belongings: Customer must remove furniture and anything else from the work area prior to starting the job. Customer must ensure working water and electricity to perform the job. 


Access to Property

Customer must ensure clear access to the property during working hours to avoid delays. Customer is responsibility for securing and removing personal belongings in and around the work area.


Scheduling

Once a scheduling date is confirmed, we will make every effort to deliver products and services on time. However, it is important to understand that in the trades, schedules can sometimes shift. Projects may be completed ahead of time, or we may encounter unforeseen challenges on prior jobs that could lead to delays. Weather conditions are another potential factor that can impact the schedule. AMC Homes is not responsible for delays or failures to complete projects due to circumstances beyond its control, such as natural disasters, pandemics, or labor strikes.


In most cases, once we begin a project, we will remain on-site until it is fully completed. Although rare, there may be instances where an emergency with an existing client requires us to temporarily leave the job. In such cases, we will work to minimize any disruption and resume the project as quickly as possible.


Warranty

AMC Homes provides a limited warranty of 1 Year on workmanship. Materials supplied by AMC Homes are supplied by manufacturers and the manufacturers warranties will vary. This warranty covers defects resulting from improper installation or assembly performed by AMC Homes.


This warranty does not cover customer-provided materials, normal wear and tear, damage caused by misuse, neglect, or modifications made after the completion of the project. All warranty claims must be submitted in writing within the warranty period.


No additional warranties, express or implied, are provided unless explicitly stated in writing.


Customer Provided Materials

If the customer chooses to provide their own materials for a project, AMC Homes assumes no responsibility for the functionality, quality, or compatibility of those materials. It is the customer's sole responsibility to ensure that all required materials are delivered to the job site on time and in sufficient quantity to avoid delays. AMC Homes will not be held liable for any delays, additional labor costs, or project disruptions caused by missing, defective, or incompatible materials provided by the customer.


Furthermore, AMC Homes reserves the right to charge additional fees for labor or other expenses incurred as a result of delays or complications caused by customer-provided materials. 


Dispute Resolution

In the event of any dispute, claim, or disagreement arising out of or related to this agreement or the services provided by AMC Homes, the parties agree to resolve such matters through mediation before pursuing any other legal remedy. If mediation does not result in a resolution, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association or a mutually agreed-upon arbitration provider.


The costs of mediation or arbitration shall be shared equally by both parties, except for attorney’s fees, which shall be borne by each party individually. Any arbitration award shall be final and binding, and judgment may be entered upon it in any court having jurisdiction.


By agreeing to these terms, both parties waive the right to pursue resolution through a court trial or jury trial, except to enforce an arbitration award or as otherwise provided by law.


Photographic and Video Documentation

AMC Homes reserves the right to take photographs and/or videos of the work site before, during, and after the completion of the project. These images may be used for quality control, project documentation, and promotional purposes, including but not limited to marketing materials, social media, and the AMC Homes website.


If the customer does not wish for photographs or videos of their property to be used for promotional purposes, they must provide written notice to AMC Homes prior to the start of the project. Such opt-out will not affect the use of photographs or videos for internal purposes, such as quality assurance or project records.


Some quotes may include example brands to illustrate the quality level of each item. These brands are provided as examples and may not necessarily reflect the actual brand used, as availability can vary. Substitutions of equal quality may be made. If you require a specific brand, it must be explicitly stated in the agreement and ordered before scheduling the project.


When removing sinks, washers, toilets, showers, or any plumbing related items where the scope is intended to reuse old plumbing connections there may be challenges with the valves or fittings that can potentially cause leaks. If we notice this while onsite we will give an option and prices to replace the items but it is always recommended to replace the hardware with the other components. We do not take responsibility for older plumbing that should be replaced.
